SERVICE AGREEMENT & INFORMED CONSENT

Welcome to Sacred Somatics, a membership created by Alchemy by Alexis LLC.  

This Service Agreement & Informed Consent (hereafter referred to as “The Agreement”) constitutes a contract between Alchemy by Alexis and you (hereafter referred to as “The Member"). As The Member, you should read it carefully and raise any questions and concerns that you may have before you sign it.

Services:

The content and resources provided in this membership program are for educational purposes only and are not intended to replace professional mental health treatment, therapy, or advice. While Alexis Bates is a licensed clinical social worker, in this context, she is not acting as your therapist or social worker, and the interactions through this program do not constitute a pracitioner/therapist-client relationship.

This membership does not offer psychological diagnosis, treatment, or personalized consultation. The membership is not individualized and does not include one on one support.  It is designed to provide tools, practices, and educational materials to support your holistic mental health journey, but it should not be used as a substitute for therapy or medical care.

If you are currently in therapy or under medical care, we encourage you to consult with your provider before incorporating any new practices from this program into your care.

If you have any existing medical conditions, physical limitations, or concerns about participating in body-based practices, we encourage you to consult with your doctor or healthcare provider before trying any of the exercises or techniques shared in this program.

Your safety and well-being are our top priority, which is why we encourage you work with your medical provider to determine what is appropriate for your physical health needs and to seek professional mental health support if needed while you're going through this membership. 

Member Responsibility and Liability Limitation:

The Member understands and agrees that participation in this membership program is voluntary and for educational purposes only. The Member is responsible for their own physical, mental, and emotional well-being, decisions, choices, actions, and results. 

Alchemy by Alexis shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use or misuse of the information or services provided in this membership program.

Alchemy by Alexis LLC, its owner Alexis Bates, and any affiliated entities will not be held liable for any physical, emotional, or psychological harm resulting from participation in this membership program. The Member assumes full responsibility for any risks or damages associated with the use of the provided information, practices, or exercises.

Emergency/Crisis Clause:

This membership program is not designed to address or treat mental health emergencies.

In the case of an emergency The Member is instructed to seek immediate help from a qualified mental health professional or contact local emergency services. For members in the U.S., call 911 and request an officer trained in crisis intervention. Additionally you can call the Suicide & Crisis Lifeline by calling 988. 

Payment Procedure:

Payments are processed automatically through Kajabi at the agreed-upon intervals. The Member is responsible for ensuring that payment details are up to date and can update payment information through their Kajabi account. Cancelation must occur before the next billing cycle to avoid being charged for the following month. 

This is a subscription-based service. Payments for each month are non-refundable, even if you do not use the services that period. 

Disclaimer of Guarantees:

The services provided through this membership aim to help The Member increase self-awareness and develop a deeper connection with their body and emotions. However, no guarantees of success are provided, as outcomes depend on individual effort, engagement, and circumstance. 

Cancellation and Termination:

The Member may cancel their membership at any time through Kajabi. Cancellations will take effect at the end of the current billing cycle, and no refunds will be provided for partial months or not using the membership in prior months. Alchemy by Alexis reserves the right to terminate the membership agreement at any time, with or without cause, by providing written notice to The Member. 

Intellectual Property Clause

All materials provided in this membership are the exclusive intellectual property of Alchemy by Alexis LLC and are intended for personal use by The Member only. The Member agrees not to reproduce, share, or distribute the materials to third parties.

Privacy and Anonymity Disclaimer:

By purchasing and joining the Sacred Somatics Membership, you acknowledge and agree that there is a community group associated with the membership. Participation in this community group involves shared interactions and discussions with other members. While we strive to create a safe and supportive space, please be aware that privacy and anonymity cannot be fully guaranteed within the community group.

As part of the group, your name may be visible to other members. We encourage all members to respect each other's privacy, but due to the nature of the group setting, personal information shared within the community may be visible to other participants. Please proceed with this understanding and only share what you feel comfortable with in a public group environment. We are not liable for any privacy breaches or disclosure of personal information shared within the group.

Dispute Resolution:

In the event of a dispute arising from this Agreement, both parties agree to resolve the matter through arbitration by a mutually agreed-upon arbitrator, which may be conducted by phone or other remote means.

By agreeing to this service agreement as The Member you acknowledges that you have read and understood the information contained in this Agreement and agree to its terms.
